Woman files hospital negligence claim for alleged botched surgery

Posted on February 4, 2015 Hospital Negligence

A woman was injured during a surgery. The doctor who performed the surgery is now facing a lawsuit after he was accused of hospital negligence. Regrettably, a number of Illinois patients are injured on a yearly basis in such a manner.

The woman had a hysterectomy performed back in 2012 at a hospital. While the surgery was being performed, the doctor allegedly perforated her bladder and also the vesicovaginal fistula. After the procedure, the woman endured an enormous amount of pain and suffering and was also forced to undergo multiple surgeries. In addition, she has been in emotional turmoil and has financial burdens.

According to the lawsuit, the doctor did not communicate with the correct medical professional to fix the mistake and also did not properly treat her symptoms. It is alleged that other standards of care were also not followed through, such as monitoring and complete exams. However, Midwest Medical has filed documents seeking dismissal of the case. The hospital claims that the woman did not include a report from a reviewing professional with the filing of her medical malpractice claim, as required.

Hospital negligence can result in patients suffering serious injuries. Often, these patients endure vast amounts of pain and suffering and are confronted with enormous medical costs. The woman in the case may be awarded a monetary judgment if evidence documents that the doctor was negligent in performing her surgery and in failing to treat her medical condition appropriately. Nevertheless, medical malpractice cases must follow prescribed procedures, and failure to do so could jeopardize a patient’s right to seek legal redress. These issues are best handled by an experienced medical malpractice attorney with whom an injured patient in Illinois should consult at the first opportunity.
