Car Seatback Defects In The News

CBS News is reporting today on its investigation into the dangers of car seatback failure — something our firm, safety experts, as well as the government and the auto industry have known about for decades.

Pfaff, Gill & Ports, Ltd. first successfully took on Ford Motor Company in the early 1990s in a product liability case involving this type of seatback defect. Our client’s 1991 Ford Explorer was rear-ended in a crash and the driver’s seat broke. Although she was wearing her seatbelt, our client was thrown into the rear occupant compartment, hit the rear seat seatback, and suffered a permanent spinal cord injury.

A few years later, we faced Ford Motor Company again, along with Mazda Motor Corporation, when we represented the family of a man killed when his 1996 Ford Escort was rear-ended at a stoplight. His weak driver’s seat failed in the crash, he was thrown into back seat, and suffered fatal head injuries. His daughter, who was in the back seat on the passenger side of the car, fractured her legs, but survived the crash.
